Property Options – An Alternative Way To Sell Your Property

Our primal objective is to provide the vendor with a higher than market value for their asset. In order for us to consider a property for purchase, the property must be suitable for redevelopment. If the property is suitable for redevelopment then this will enable Midas Touch Towers to improve the value of the land by obtaining a Development Approval (DA) from council. But first, an agreeement must be made betweeen the vendor and Midas Touch Towers to exchange land for an agreed price, at an agreed time. our Option Agreement terms are usually set between a period of 18 to 24 months.

FAQ

When should I call you to sell??
When you are ready, it could be next week, next month or next year. It is important that you give yourself sufficient time within the option agreement to meet your own guidelines.

How do I know that I will receive an Above Market Value sale?
During our discussions I would ask you 1) the dollar figure you want for your property and 2) the length of term you would prefer for our option agreement. This gives you the opportunity and the right to determine the payout figure which would be above market value. I would undertake my own feasibility with your figure in mind to determine if the payout figure is able to provide a win/win situation for both you and me. If we both want a deal and if we are able to compromise in order to secure a joint positive end result, there definitely will be a beneficial agreement between you and me.

Whilst my property Under Option can I negotiate to sell with another person or company?
No, During the term of the option no-one else can buy or sell the property.

Why does it take longer time to sell my property under Option?
Property Option agreements are normally undertaken between 18 to 24 months, terms which were proposed by the property owners in order to satisfy their requirements. This period also allows Midas Touch Towers the time to obtain at our cost the Development Approval (DA).

If I'm still the owner how can you obtain a Development Approval?

Within the terms of our agreement there are various clauses that we both include in order to protect our respective interests. One of these clauses states that you shall give me written authority to consult with surveyors, architects, engineers, town planners, local and state government entities and other parties in order to submit plans etc to obtain a DA. All of these consultations are done at my cost.

Can I as the owner insert any clauses in the Options Agreement?

These are all by mutual agreement as this has to be a positive result for both of us. For example, let’s say the agreed term is 24 months, but because of personal/family or other reasons you do not want to have the option exercised before 19 months have elapsed. In this situation we would add a clause to the agreement to determine that intent and settlement will then not occur within the first 19 months of the agreement.

If I enter into an options agreement with you can I retain a share of the property or development?

Yes.

Do you buy property if it has no potential for development?

Yes, in some circumstances we will conduct a due-diligence assessment on the property, it’s location, condition and at Market Value. At the time of your request to sell, we may have a buyer interested in purchasing your type of property.
